Terms of Service

Welcome to TAKE ME THERE. These Terms of Service ("Terms") govern your access to and use of our app, website, and rideshare marketplace (the "Service"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

Riders must be at least 18 years old and able to enter into a binding contract. Drivers must be at least 21 years old (or the minimum age required by their market), hold a valid driver's license, and meet vehicle and background-check requirements.

2. Account Registration

You must provide accurate information and keep your credentials secure. You are responsible for activity under your account and must not share access with others.

3. The Service

TAKE ME THERE is a marketplace that connects riders with independent drivers. We facilitate requesting, matching, trip tracking, fare calculation, and payment. We are not a transportation carrier and do not employ drivers.

4. Rider Terms

• Request rides only for yourself or someone you are authorized to arrange travel for;
• Be ready at the pickup location and verify the driver using the ride PIN;
• Pay all applicable fares, fees, and tolls;
• Wear a seatbelt and follow applicable laws;
• Treat drivers respectfully and do not engage in prohibited conduct.

5. Driver Terms

Drivers are independent contractors, not employees. Drivers agree to:

• Maintain a valid license, insurance, and a roadworthy, approved vehicle;
• Pass background checks and complete the approval process before driving;
• Comply with all applicable laws and regulations;
• Provide safe, professional service and accept trips in good faith;
• Keep availability and location data accurate while online.

6. Driver Preference Feature

Where supported, riders may request a woman or man driver. This preference is fulfilled only when a matching driver is available and is never guaranteed. It is offered to support rider comfort and safety and is not a basis for unlawful discrimination against any driver or rider.

7. Fares, Payments, and Payouts

Fares are calculated based on base fare, distance, time, applicable surge multipliers, tolls, and optional tips. Rider payments are processed by Stripe. Driver payouts are calculated after applicable platform fees and are made according to your payout settings. Promotions may apply subject to their specific terms.

8. Cancellations and No-Shows

Cancellation and no-show fees may apply. Repeated cancellations or no-shows may result in restrictions on your account.

9. Safety and Conduct

You must comply with our safety standards, including ride PIN verification and the Safety Center. You may use live trip sharing and one-tap help features. Prohibited conduct includes violence, threats, harassment, discrimination, illegal activity, intoxication, weapons, and fraud. Violations may result in immediate suspension or removal.

10. Ratings

Riders and drivers rate each other after each trip. Ratings support trust and quality and may affect continued access to the Service.

11. Privacy

Our handling of your information is described in our Privacy Policy, which is incorporated into these Terms.

12. Intellectual Property

The Service, including the TAKE ME THERE name, logo, and software, is owned by us or our licensors and protected by intellectual property laws. You receive no rights except as expressly stated in these Terms.

13. Disclaimers

The Service is provided "as is" and "as available." To the extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose. We do not guarantee that drivers will be available, that any trip will be completed, or that the Service will be uninterrupted or error-free.

14. Limitation of Liability

To the maximum extent permitted by law, neither TAKE ME THERE nor its affiliates will be liable for indirect, incidental, special, consequential, or exemplary damages, or for lost profits, arising from your use of the Service.

15. Dispute Resolution and Arbitration

Except where prohibited by law, any dispute will be resolved by binding arbitration on an individual basis, and you waive any right to participate in a class action. The arbitration will be governed by applicable law and the rules of the relevant arbitration provider.

16. Termination

You may delete your account at any time. We may suspend or terminate your access if you violate these Terms or for any other reason at our discretion, with notice where appropriate.

17. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
